RULES AND REGULATIONS

This Black & Decker Storm Sweepstakes (the “Sweepstakes”) is sponsored by Black & Decker (U.S.) Inc. (“Black & Decker”). The Sweepstakes begins on or about September 22, 2005 and ends on November 3, 2005 (the “Sweepstakes Period”).

1. No Purchase Necessary To Enter Or Win

2. How To Enter. In order to enter, each participant must completely fill out the information required on the Entry Form (the “Entry Form”) available at www.blackanddecker.com/win during the Sweepstakes Period. The information requested marked “optional” on the Entry Form may be answered at the participants’ discretion.

Black & Decker reserves the right to verify that the Winners are qualified and entitled to receive a prize. The Winners will be required to complete an Affidavit of Eligibility and Liability/Publicity Release or his/her prize will be forfeited. Acceptance of the prize constitutes permission (except where prohibited by law) to use the Winners’ name, likeness, biographical information, photographs and any statements or remarks made about winning the prize or participating in the Sweepstakes for advertising and promotional purpose without additional compensation.

3. Drawing. The random prize drawing will be held at the Black & Decker headquarters in Towson, Maryland on or about November 30, 2005. All qualified entries will be placed in the random prize drawing. The first (1) entry drawn will each be declared a Winner. A Black & Decker representative will be present to conduct the drawing. Participants need not be present to win. The Winner will be notified either by e‑mail within seven (7) days of the drawing. Odds of winning the prizes depend on the number of eligible entries received.

4. Prize. The Winner will receive a Black & Decker SS925 Storm Station Rechargeable Power Source (approximate retail value of $99), a Black & Decker LP1000 Alligator Lopper (approximate retail value of $149.99), and a additional Black & Decker BV4000 Blower Vac (approximate retail value of $69.99), for an approximate total value of $318.98. The Winner should allow 4 – 6 weeks from notification for delivery of prizes. Prize is non-transferable. Black & Decker reserves the right to substitute any prize for a prize of equal or greater value.

5. Eligibility. The Sweepstakes is open to legal residents of the USA, 18 years or older. Employees of Black & Decker and its affiliates, manufacturers, sales reps, subsidiaries or parent companies, advertising/sales promotion agencies and the immediate families of each are not eligible. Void where prohibited. Entry materials become the property of Black & Decker and will not be acknowledged or returned. Black & Decker is not responsible for lost, late, damaged, misdirected or illegible Entry Forms. Limit of one (1) entry per participant per day.

6. Conditions. All Federal, state and local laws and regulations apply. Income and other taxes are the responsibility of the Winners. By submitting an Entry Form, each participant agrees to be bound by these Sweepstakes rules, and the decisions of Black & Decker are final. Each participant agrees to release and hold Black & Decker, its employees, officers, directors, shareholders, agents, representatives and its subsidiaries, parent companies or other affiliated companies harmless from any and all damages, losses, claims and/or liabilities arising out of his participation in the Sweepstakes or resulting from accepting or claiming of any prize awarded hereunder. Black & Decker reserves the right, in its sole discretion, to terminate, suspend or otherwise cancel the Sweepstakes at any time.

7. Winner

To obtain the name of the Winners send a self-addressed, stamped envelope to Black & Decker Storm Sweepstakes Winner Request, 701 E. Joppa Road, R690, Towson, Maryland 21286.
